1. Agreement to Terms
By accessing or using PromoPack (“the Service”), you agree to be bound by these Terms of Service (“Terms”), including the Critical Disclaimer above. If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
PromoPack is a workflow assistance tool that helps pharmaceutical and healthcare organizations organize promotional content documentation. The Service assists with claim extraction, reference linking, and document organization. This is NOT a compliance system and does NOT guarantee regulatory compliance.
Human review by qualified professionals is always required before any materials are used for promotional purposes.
3. User Accounts
3.1 Account Creation
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2 Professional Use Only
The Service is intended for use by qualified professionals in the pharmaceutical and healthcare industries. You represent that you are authorized to use the Service in your professional capacity.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. We are committed to complying with GDPR, HIPAA, and other applicable privacy laws.
8. Payment Terms

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
WHILE WE PROVIDE TOOLS TO ASSIST WITH REGULATORY COMPLIANCE, WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICE WILL RESULT IN COMPLIANT MATERIALS. YOU ARE SOLELY RESPONSIBLE FOR ENSURING COMPLIANCE WITH APPLICABLE LAWS AND REGULATIONS.
12. Limitation of Liability
IN NO EVENT SHALL PROMOPACK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless PromoPack from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
15. Changes to Terms
We may modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance.
